1. Introduction

1.1. These terms and conditions and the documents referred to below ("Terms") apply to the use of the current website ("Website") and its related or connected services (collectively, the "Service").

1.2. You should carefully review these Terms because they contain important information concerning your rights and obligations when using the Website and form a binding legal agreement between you, our customer ("Customer", "Player", "User", or "you"), and us.

1.3. By using the Website or accessing the Service, whether as a guest or a registered user with an account ("Account"), you agree to be bound by these Terms, our Privacy Policy, and any other rules or policies published on the Website, together with any amendments published from time to time. If you do not accept these Terms, you must not access the Service or use the Website.

1.4. The Service is owned by Fortaluna Ltd, a limited liability company registered in Belize under company registration number 000048757, with its registered address at Sea Urchin Street, San Pedro Town, Ambergris Caye, Belize. The Company is licensed in the State of Anjouan under the Computer Gaming Licensing Act 007 of 2005 to provide online casino, betting, and games of chance.

1.5. In these Terms, "Bonus" means any promotional credit, free spin, free bet, reward, or incentive offered by the Company; "Cryptocurrency" means any supported digital or virtual currency accepted on the Website; "Funds" means the monetary or cryptocurrency balance held in your Account; "Game" means any game, betting product, or wagering activity made available on the Website; "KYC" means Know Your Customer identity verification procedures; "Restricted Territory" means any jurisdiction listed in Section 4.1.3 or otherwise prohibited by applicable law; and "Wager" or "Bet" means any stake placed by a Customer on a Game.

2. General Terms

2.1. We reserve the right to revise and amend these Terms, including any documents referred to or linked below, at any time. You should visit this page periodically to review the Terms.

2.2. Amendments are binding and effective immediately upon publication on the Website. Where changes are material, we will take reasonable steps to notify you, for example by email or an on-site notice. If you object to any change, you must immediately stop using the Service. Your continued use of the Website after publication indicates your agreement to be bound by the amended Terms.

2.3. Any bets not settled before amended Terms take effect remain subject to the Terms that were in effect when the bets were placed.

2.4. We operate in accordance with the conditions of our licence and applicable Anjouan gaming regulations, including obligations relating to anti-money laundering, customer protection, and responsible gambling.

3. Your Obligations

When accessing the Website and using the Service, you acknowledge and agree at all times that:

3.1. You are over 18, or the higher legal age at which gambling or gaming activities are allowed under the law applicable to you. We reserve the right to request proof-of-age documents from you at any time.

3.2. You have legal capacity and can enter into a binding legal agreement with us. You must not access the Website or use the Service if you do not have legal capacity.

3.3. You are resident in and accessing the Website from a jurisdiction that allows online gambling. It is your sole responsibility to ensure that your use of the Service is legal. The availability of the Website in any location does not constitute an offer or invitation where such use is illegal.

3.5. You are the authorised user of every payment method you use.

3.6. You must make all payments to us in good faith and must not attempt to reverse a payment or take any action that will cause a third party to reverse it.

3.7. When placing bets, you may lose some or all of the money deposited to the Service in accordance with these Terms, and you are fully responsible for that loss.

3.8. When placing bets, you must not use information obtained in breach of any legislation in force in the country from which the bet was placed.

3.9. You are not acting on behalf of another party or for any commercial purpose, but solely on your own behalf as a private individual.

3.10. You must not attempt to manipulate any market or element within the Service in bad faith or in a manner that adversely affects the integrity of the Service or the Company.

3.11. You must act in good faith in relation to the Company and the Service at all times and for all bets made using the Service.

3.12. Neither you nor, where applicable, your employees, employers, agents, or family members may be registered as an affiliate in our affiliate programme while using the Service.

4. Restricted Use

4.1. You must not use the Service:

4.1.1. If you are under 18, below the higher age of majority stipulated by the law applicable to you, or otherwise unable to enter into a binding legal agreement with us; or if you are acting as an agent for or on behalf of such a person.

4.1.2. If you reside in or access the Website from a country in which online gambling is prohibited.

4.1.3. If you are resident in, located in, or accessing the Website from any of the following Restricted Territories:

• Any other jurisdiction deemed prohibited by the Anjouan Offshore Financial Authority

4.1.4. To collect nicknames, email addresses, or other information about Customers by any unauthorised means, including spam, unsolicited email, framing, or linking to the Service.

4.1.5. To disrupt, unduly affect, or influence the activities of other Customers or the operation of the Service.

4.1.6. To promote unsolicited commercial advertisements, affiliate links, or other forms of solicitation, which may be removed from the Service without notice.

4.1.7. In any way that, in our reasonable opinion, could be considered an attempt to cheat the Service or another Customer, or to collude with another Customer to obtain a dishonest advantage.

4.1.8. To scrape our odds or otherwise violate our intellectual property rights.

4.1.9. For any unlawful activity whatsoever.

4.2. You may not sell or transfer your Account to a third party, acquire an Account from a third party, or transfer funds between Customer Accounts.

4.3. We may immediately suspend or terminate your Account by written notice if you use the Service for an unauthorised purpose. We may also void bets, confiscate balances where permitted by these Terms, and take legal action in appropriate circumstances.

4.4. Anyone who is an employee, officer, director, consultant, agent, or affiliate of the Company, or an employee of its licensees, distributors, wholesalers, subsidiaries, advertising or promotional agencies, media partners, contractors, or retailers, and the immediate family members of each, may not use the Service for real money without prior consent from a Company director or the Chief Executive Officer, or where doing so could create a conflict of interest. If such activity is discovered, the Account will be immediately terminated and all bonuses and winnings forfeited.

4.5. Persons subject to international sanctions or appearing on any sanctions, terrorism, or politically exposed person watchlist may be refused service or have their Account restricted.

4.6. We reserve the right to add or remove jurisdictions from the Restricted Territories at any time to comply with applicable law, our licence, or the terms of our service providers.

5. Registration

When registering for and using the Service, you agree that:

5.1. We may refuse any registration application at our sole discretion without being obliged to provide a specific reason. If we close an existing Account, we will return legitimate Customer funds other than amounts lawfully withheld.

5.2. Before using the Service, you must personally complete the registration form and read and accept these Terms. Before you can place bets or withdraw winnings, we may require you to become a verified Customer by completing checks and providing valid proof of identification and any other documents we reasonably require. These may include a passport, driving licence, or national identity card and a recent utility bill showing your name and address. We may suspend wagering or restrict Account options until we receive the required information. This procedure is carried out in accordance with applicable gaming regulation and anti-money laundering requirements. You must fund your Account using a payment method offered in the payment section of the Website.

5.3. You must provide accurate contact information, including an active and unique email address ("Registered Email Address"), and keep that information up to date. We identify and communicate with Customers through their Registered Email Address, including for Account notices and changes to these Terms. You are responsible for maintaining its security and for notifying us of any change. We are not responsible for losses alleged to result from communications sent to the Registered Email Address. We may suspend an Account until a reachable email address is provided, or immediately suspend an Account if false or inaccurate personal information is intentionally supplied. We may also take legal action or contact the relevant authorities where appropriate.

5.4. You may register only one Account. Accounts opened or controlled by the same individual, or by individuals acting in concert ("Duplicate Accounts"), may be immediately closed. This includes Accounts registered or operated by representatives, relatives, associates, affiliates, related parties, connected persons, or third parties acting on your behalf. We may void related bets or forfeit associated winnings, bonuses, and balances where permitted by these Terms.

5.5. To assess financial standing and confirm your identity, we may request additional personal information, including your name and surname, or use third-party information providers we consider necessary. We will inform you about personal information obtained from third-party sources.

5.6. You must keep your password confidential. If the requested Account information has been correctly supplied, we are entitled to assume that bets, deposits, and withdrawals were made by you. You should change your password regularly, never disclose it to a third party, and log out after each session. You must notify us immediately if you believe that your Account or Registered Email Address has been compromised or misused. We may require additional information or documents to verify your identity and will suspend your Account once we become aware of such an incident. Until then, you are responsible for all Account activity, including third-party access, whether or not authorised by you.

5.7. You must not transmit Service content or information to another Customer or party by screen capture or a similar method, or display it in a frame or in any manner different from how it would appear if the Customer or third party entered the Service URL in a browser.

5.8. When registering, you will have the option to use all currencies available on the Website. These will be the currencies used for your deposits, withdrawals, and bets placed and matched through the Service under these Terms. Some payment methods do not process all currencies. In those cases, a processing currency will be displayed, along with a conversion calculator available on the page.

6. Identity Verification (KYC) and Anti-Money Laundering (AML)

6.1. We are committed to preventing money laundering, terrorist financing, and fraud, and operate in accordance with applicable AML/CTF obligations.

6.2. We may, at any time and at our sole discretion, require you to complete identity and source-of-funds verification, including by providing:

• a government-issued photo ID (passport, national ID, or driving licence);
• proof of address (utility bill or bank statement, typically issued within the last 3 months);
• proof of ownership of the payment method or cryptocurrency wallet used;
• evidence of source of funds or source of wealth;
• a selfie or live verification check.

6.3. Withdrawals may be withheld until verification is satisfactorily completed. We may suspend or close your Account, and report to relevant authorities, where verification fails or where we have reasonable grounds to suspect fraudulent, illegal, or suspicious activity.

6.4. We may apply transaction monitoring, deposit/withdrawal limits, and enhanced due diligence in line with our risk-based AML procedures.

6.5. By using the Website, you consent to us carrying out such verification checks, including using third-party data providers, and to the processing of your data for these purposes as described in our Privacy Policy.

7. Deposits

7.1. You may only deposit funds using payment methods registered in your own name or from a cryptocurrency wallet under your control.

7.2. Funds deposited must originate from legitimate sources. We reserve the right to request evidence of the source of any deposit.

7.3. The minimum and maximum deposit amounts, supported currencies, and any applicable fees are displayed on the Website and may change from time to time.

7.4. For cryptocurrency deposits, you are responsible for ensuring that funds are sent to the correct deposit address using the correct network. We are not liable for funds lost due to transfers to incorrect addresses, use of unsupported networks, or user error.

7.5. Cryptocurrency values may fluctuate. We are not responsible for any loss in value resulting from exchange rate movements between deposit, play, and withdrawal.

7.6. Your Account is not a bank account. No interest is payable on balances, and funds are not protected by any deposit guarantee or insurance scheme.

8. Withdrawals

8.1. You may request a withdrawal of available funds at any time, subject to completion of KYC verification, satisfaction of any applicable wagering requirements, and these Terms.

8.2. Withdrawals are generally paid to the same method or wallet used to deposit, where reasonably possible.

8.3. We reserve the right to set minimum and maximum withdrawal limits and to process withdrawals in instalments where amounts are large.

8.4. We may delay or withhold a withdrawal where verification is incomplete, where we are investigating suspected fraud, bonus abuse, or breach of these Terms, or where required by law.

8.5. Withdrawal processing times are indicative only and may be affected by verification, security checks, blockchain network conditions, or third-party processors.

8.6. We reserve the right to deduct from any withdrawal any amounts owed to us, including amounts wrongly credited, bonus amounts forfeited, or chargebacks.

9. Bonuses and Promotions

9.1. All bonuses, promotions, and rewards are subject to these Terms and to the specific terms of the relevant promotion ("Bonus Terms"), which prevail in the event of conflict.

9.2. Unless stated otherwise, bonus funds and any winnings derived from them are subject to wagering requirements before they may be withdrawn.

9.3. We reserve the right to amend, suspend, cancel, or withdraw any bonus or promotion at any time.

9.4. Bonus abuse. Any attempt to gain unfair advantage from bonuses, including but not limited to opening multiple accounts, collusion, arbitrage betting, low-risk/hedge betting designed solely to satisfy wagering requirements, or using automated systems, is prohibited. Where we detect bonus abuse, we may void the relevant bonus and any winnings derived from it, and close the Account.

9.5. Only one bonus may be active at any time unless expressly stated otherwise.

9.6. We reserve the right to exclude any Player from any promotion at our discretion.

10. Wagering and Game Rules

10.1. By placing a bet, you confirm that you understand the rules of the relevant Game and accept them.

10.2. A bet is only valid once accepted and confirmed by our systems. We reserve the right to refuse any bet, in whole or in part, before it is accepted.

10.3. Maximum bet and maximum payout limits may apply to individual Games and are displayed where applicable.

10.4. Game outcomes are determined by certified random number generators (RNG) or, for live and third-party games, by the relevant game provider's systems.

10.5. In the event of any discrepancy between the result shown on your device and our server records, the result recorded on our servers shall prevail.

11. Errors, Malfunctions, and Disputes

11.1. In the event of a system malfunction, technical error, or human error affecting odds, payouts, game outcomes, or balances, we reserve the right to void the affected bets and correct the error, including by adjusting balances.

11.2. Malfunction voids all pays and plays. If a Game malfunctions, any affected bets and resulting winnings are void.

11.3. Where an amount is credited to your Account in error, that amount remains our property and will be deducted. If you have withdrawn funds to which you were not entitled, you must return them on request.

11.4. You agree to inform us promptly of any error or incomplete transaction affecting your Account.

12. Responsible Gambling

12.1. We are committed to responsible gambling and providing tools to help you stay in control. Gambling should be a form of entertainment, not a source of income.

12.2. Tools such as deposit limits, cooling-off periods, and self-exclusion are available on request or through your Account settings.

13. Prohibited Conduct

• collude with other Players;

• attempt to hack, interfere with, reverse-engineer, or disrupt the Website or its security;
• provide false, misleading, or fraudulent information;
• engage in chargebacks or payment disputes without first contacting us.

13.2. We reserve the right to suspend or close any Account, void bets, and confiscate balances where we reasonably believe these Terms have been breached.

14. Intellectual Property

14.1. All content on the Website, including software, games, text, graphics, logos, trademarks, design, and source code, is owned by or licensed to the Company and is protected by intellectual property laws.

14.2. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Website for personal, non-commercial entertainment only. You may not copy, distribute, modify, or create derivative works without our written consent.

15. Limitation of Liability

15.1. The Website and all Games are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, express or implied.

15.2. We do not guarantee that the Website will be uninterrupted, error-free, or free of viruses or harmful components.

15.3. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive losses, or for any loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of the Website.

15.4. Our total aggregate liability to you in connection with the Website shall not exceed the amount of funds held in your Account at the relevant time, or USD 10,000, whichever is lower.

15.5. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15.6. You agree to indemnify and hold harmless the Company, its officers, employees, and partners against any claims, losses, or costs arising from your breach of these Terms or your unlawful use of the Website.

16. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government action, power or internet outages, blockchain network failures, or third-party provider failures.

17. Complaints and Dispute Resolution

17.1. If you have a complaint, please contact our support team at support@pumpkings.com in the first instance. We aim to acknowledge complaints within 72 hours and resolve them as quickly as possible.

17.2. If a complaint cannot be resolved internally, it may be escalated to the relevant licensing authority in Anjouan in accordance with the procedures applicable to our licence.

17.3. The records held on our servers shall be the final authority in resolving any dispute regarding bets, balances, or game outcomes.

18. Governing Law and Jurisdiction

18.1. These Terms are governed by and construed in accordance with the laws of the Autonomous Island of Anjouan, Union of Comoros.

18.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts and regulatory bodies of Anjouan, save where applicable mandatory law provides otherwise.

19. Severability and Waiver

19.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19.2. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

20. Assignment

We may assign or transfer our rights and obligations under these Terms to any third party, including in connection with a sale or restructuring of our business. You may not assign your rights or obligations without our prior written consent.
